Medical Lien Requisites 

All Orders that exceed a quantity of 5 entries must Register.

To ensure the perfection of a lien issued under § 33-931, the executive officer, a licensed healthcare provider, or the representative of a healthcare provider must document, either prior to or within a period of thirty days following the patient's receipt of any services related to their injuries, This documentation should be a signed written statement that details all of the requested information listed on both the Lien Release Form and 

For medical professionals not affiliated with hospitals, who have the claimant's knowledge, the contact details and locations of every individual, business, or company, along with their insurance providers, that the injured individual or their representative has identified as responsible for the damages resulting from the injuries for which the individual sought medical treatment.

To release a claim with a lien or assignment under § 33-931, the lien-holder or assignee must join or execute the release. If any amount has been or is to be collected by the injured person or that person's legal representative from or on behalf of the person, firm, or corporation liable for damages as a result of a judgment, settlement, or compromise, the claimant or assignee of the lien or assignment may enforce the lien or assignment by action against the person, firm, or corporation that is liable for damages, or against any insurer or other individual, company, or organization who is liable for all or part of the losses.

 

An action under this section must be brought and tried in the county where the lien or assignment is filed, unless the court orders that it be relocated to another county for reason. The court may approve reasonable legal costs and expenses for the successful party. The action must be brought within two years after the entry of the verdict or the making of the settlement or compromise. In an action to enforce a lien or assignment, the lien=holder or assignee may not recover more than the amount of the lien or assignment, nor may it recover more against a defendant in the lien action than that defendant is required to pay by judgment or settlement. The defendant in a lien or The defendant in the lien or assignment action cannot raise as a defense in that action that it is not liable for the amount it is obligated to pay under the judgment or settlement, except that it can dispute the amount of the lien on the grounds that the charges giving rise to the lien are erroneous or exceed the customary charges, or that the care, treatment, or transportation giving rise to the charges was not medically necessary or causally related to the event giving This section does not provide any rights or causes of action for the lien-holder other than those expressly provided for in this section.

For Expedited Request

  • Expedited filings are urgent documents that need to be prepared and submitted within 24 hours on weekdays, excluding weekends and holidays.

  • To request expedited filing, documents must clearly state the need for it and include the extra fee.

  • The 24 hour period will start from the moment the expedited filing request is received, during regular business hours.

  • For expedited requests made after hours, on weekends, or holidays, the 24-hour period will start from the next business day after the request is received.

  • For all Request, anytime you submit on a holiday, a weekend or a business day after 5pm, you must select the next business day as Selected Recording Date. The recording services are available Monday - Friday from 8:00AM to 5:00PM mountain standard time, excluding holidays.

Liens 2 Go, LLC ensures that the lien or lien release is properly formatted, has a correct signature attached, and is filed with the appropriate County Recorder's Office or Arizona Secretary of State Office and is mailed to all responsible parties within 5 business days, unless expedited filing is expressly requested.
